Home Occupations, Day Cares & Garage Sales
Home Occupations
Home occupations are defined as any occupation or profession conducted entirely within a dwelling unit by the inhabitants thereof which is clearly incidental and secondary to the use of the premises for dwelling purposes and does not change the residential character thereof. There are several hundred licensed home occupations in Grandview.
A yearly home occupation permit is issued by the Community Development Department without charge. The permit verifies that the home occupation is permitted and that it will follow the performance standards in the zoning ordinance. In most cases a city occupation license will also be required, which includes an annual fee and monitoring for compliance with city and state requirements. Limits on a home occupations:
- No change in outside appearance or signage
- No additional traffic, parking, sewerage or water use
- No outside storage
- No creation of hazard, nuisance, or electrical interference
- No employees other than self or family
- No more than 25% of floor area of dwelling used for business
- No deliveries of materials other than parcel post or similar parcel service vehicles
- No noise, vibration, smoke, odors, heat or glare
- Advertising limited to use of name, phone number, and post office box.
- Limit of one private commercial vehicle no greater than three-quarter ton capacity
- Customer and client contact shall be primarily by telephone, mail or email and not on premises except home occupations such as tutoring, teaching, babysitting or personal services.
- Some prohibited home occupations are: animal grooming, auto repair, beauty and barber service, printing, physicians, appliance repair, lawn care services, and sales to the public on the premises.
Home Day Cares
The State of Missouri and the City of Grandview each have separate regulations that apply to home day care businesses. If you care for less than 5 unrelated children, you are only required to receive an annual home occupation permit from the City of Grandview. If you care for between 5 and 10 unrelated children, you must be licensed with the State of Missouri and receive a home occupation permit from the City of Grandview. Ten unrelated children is the maximum allowed in a home in a residential zoning district. For information about the State requirements please call 325-5873. A key reason why Grandview requires a home occupation permit for home day care is to insure the safety of the children through compliance with the Fire Code. All home-based day care businesses in Grandview must receive Fire Department approval before a permit will be issued.
Persons who operate a home day care without a home occupation permit may be subject to a fine. Each day the violation continues may be considered a separate violation.

Gargage Sales
These are sales operated at a residence for the sale of new or used household goods or property. Sample sales are permitted if operated by a sales representative and held at his/her own residence.
LIMITS ON GARAGE SALES:
- You may hold four (4) sales at your home per calendar year, no longer than three (3) consecutive days per sale.
- Attaching signs advertising sales to telephone poles, utility poles, or street signs is prohibited.
- Signs are not permitted to be placed in any public right-of-way, which includes the "common area" between the street and sidewalk and in street medians. Typically, public right-of-way extends eleven (11) feet inward from the curb.
- Be sure to acquire permission from the adjacent property owner before putting any signs on private property.
- Items for sale must be placed in the garage or driveway of a residence. Displaying items in the yard is not permitted.

New Addresses & Address Changes
The Development Services Division staff keeps a master listing of addresses on special detailed maps of the city and handles the assignment of any new addresses or changes to existing addresses. Staff will review the requested address for compatibility with the address system and, if approved, will notify all necessary organizations and agencies.

Grandview Neighborhood Alliance
The Grandview Neighborhood Alliance is a voluntary organization which functions to facilitate communication within neighborhoods, between neighborhoods, and between neighborhoods and the City government in order to improve the appearance, image, safety and vitality of Grandview's neighborhoods and the City as a whole. The Neighborhood Alliance regularly meets on the evening of the third Monday of the month at City Hall. Call (816) 316-4822 for information.

Site Plan Process & Pre-Application Meetings
Anyone interested in constructing new structures, or expanding existing commercial and apartment structures must follow the site plan review process. Exemptions from this process are single and two-family residential units.
Call (816) 316-4822 to arrange a required pre-application meeting with Community Development Department staff, the City Engineer, the Fire Department staff and the local Water District Engineer, and possibly representatives of other agencies that may be affected by the proposed project.
Following this meeting, a site plan can be submitted for review by city staff and all utility companies with service in the area of the project. Within 15 working days, either a site plan approval or re-submittal comments will be generated. After a site plan is approved with the city, and a building permit has been reviewed and approved, then the project can proceed.

Parking Lot & Landscape Maintenance
All parking lot surfaces and lot striping, handicapped parking spaces and pole signs, and landscaping must be maintained on an on-going basis once installed. While Community Development regularly surveys the community and notifies property owners if properties are lacking in maintenance of these items, it is the property owners' responsibility to maintain parking areas and landscaping. Screening of Dumpsters & Storage Areas
Section 23-32 of the Grandview City Code requires all commercial solid waste containers to be placed on a permanently paved surface and screened to a height of six (6) feet with solid fencing providing one hundred percent opacity on all sides. An additional self-closing pedestrian access gate is also required.
The Grandview zoning ordinance requires outdoor storage areas to be screened from view to varying degrees, dependent upon zoning district and proximity of residential areas and major thoroughfares. All of these "tools" are designed to provide direct or indirect assistance to encourage expansion of existing companies and the location of new companies in the Grandview Community. Planning Commission & Tax Increment Financing Commission
The Grandview Planning Commission consists of seven members appointed by the Mayor with the consent of the Board of Aldermen and who serve without pay. Commission terms are four years in length.
The Commission has all the powers and duties authorized by Chapter 89 of the Revised Statutes of Missouri, as amended. The Planning Commission's powers and duties include preparing and overseeing the administration of the City's Comprehensive Plan and holding public hearings and making recommendations to the Board of Aldermen on such land development projects as zoning district map and text amendments, conditional use permits, subdivision plats, utility easement and right-of-way vacations, and planned development projects.
The Planning Commission also acts as the Tax Increment Financing Commission.

Meeting Schedule
The Planning Commission meets on the fourth Wednesday of the month at 7:00 PM inside Grandview City Hall, 1200 Main Street. Zoning Map Amendments
Any owner of property in the City of Grandview has the right to request a change in the zoning classification of their property. Such an action must promote the health, safety,and general welfare of the community as a whole. A request for rezoning of property is reviewed by both a seven member appointed body called the Planning Commission and the Board of Aldermen with final approval or denial authorized by the Board of Aldermen.
A person requesting an amendment to the Zoning District Map for a property must demonstrate that the requested amendment is more appropriate than the present zoning classification, considering the characteristics of the property and the overall public welfare.
It should be noted that the reclassification of zoning of property is a legislative function that should only be exercised sparingly and under proper conditions. For this reason, it is the policy of the Board of Aldermen that the reclassification of zoning of property is to be
authorized only where a clear showing has been made that circumstances and conditions affecting the property in question have so materially changed so as to demand reclassification in the public interest.
NOTE: Changes in zoning must conform to the Future Land Use Plan for the City of Grandview. Should an amendment to the Future Land Use Plan be required, such would need to be requested and authorized prior to any zoning change consideration. An amendment to the Future Land Use Plan follows the same procedures as does a rezoning request.
Zoning Text Amendments
The text of the zoning ordinance must be updated from time to time to correct errors, oversights, or to insert new procedures and categories. Zoning text amendments are typically initiated by staff or the Planning Commission and follow the same procedure for approval as zoning map amendments.
Planned Developments
Any developments proposed within a Planned District zone require the submittal of a Conceptual Development Plan for the project to the City for approval. Approval of this plan follows the same procedure as zoning map amendments.
Conditional Use Permits
Conditional uses are those types of land uses which are, by their nature, dissimilar to the uses normally permitted within a given zoning district. Conditional uses could negatively impact public safety, welfare, or property values of the immediate neighborhood. It is for this reason that specific restrictions are placed on these land uses. Requests for conditional use permits are reviewed by both a seven member appointed body called the Planning Commission and by the Board of Aldermen with final approval or denial authorized by the Board of Aldermen.
Land uses which may be allowed as conditional uses are listed under each zoning district. Each use has specific restrictions and performance standards placed on it and conditional uses may be permitted subject to these express limitations.
Standards used in evaluating a request for a conditional use permit include the following:
- Compliance with all applicable City codes
- Review of proposed site plan for adequate landscaping, screening, parking, lighting, utility, and storm drainage improvements
- Adequate access to the site; possible traffic conflicts or congestion
- Nature and intensity of proposed activities and its effect on the neighborhood
- Effect of proposed use on the value of surrounding property; possible benefit to the neighborhood.
Vacation of Easements and Rights-of-Ways
The Planning Commission holds public hearings to consider applications for vacation of utility easements or street rights-of-way and provides recommendations to the Board of Aldermen.
Subdivision Plat Review
The Planning Commission reviews and provides recommendations to the Board of Aldermen regarding applications to approve Preliminary and Final Subdivision Plats.

The Zoning Board of Adjustment consists of eight members appointed by the Mayor with the consent of the Board of Aldermen and serve without pay. The Board's terms are five years in length.
The Board has all the powers and duties as authorized by the Grandview Zoning Ordinance and Chapter 89 of the Revised Statutes of Missouri, as amended. The Board holds public hearings to hear requests for variances to the strict application of the zoning ordinance and appeals of administrative decisions made by city staff.

Variances & Appeals
The powers of the Board of Adjustment are strictly limited by Missouri State Statutes, and variances from the regulations of the Zoning Ordinance my only be granted by the Board where there are practical difficulties or unnecessary hardships created by the strict enforcement of the Zoning Ordinance. The Board cannot grant a variance based upon an economic hardship or a self-imposed hardship.
The Zoning Board of Adjustment may hear appeals as follows:
Variance from the regulations of the Zoning Ordinance--When the strict enforcement of the Zoning Ordinance would create a unique or unnecessary hardship, the Board has the power to vary or modify the strict application of the ordinance.
Ordinance Interpretation-The Board shall decide appeals when it is alleged that there is an error in any order, requirement, decision, or determination made by an administrative official in enforcing the provisions of the Zoning Ordinance.
